1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website (the “Website”) and all services provided by Panipat Chess (the “Services”), a chess club and coaching academy operated by Tensai Ventures LLC.
 
By accessing the Website or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access the Website or use the Services. If you are accessing the Website or using the Services on behalf of a minor, you represent that you are the minor’s parent or legal guardian and that you accept these Terms on the minor’s behalf.
 

2. Description of Services

Panipat Chess provides chess instruction, coaching, and competitive programming through in-person classes at its operating address (A-82 Sushant City Ansal, Panipat, Haryana, India – 132103) and through online platforms. The Services include, but are not limited to, group training programs (Groups A, B, and C), tournament organization, game analysis, and access to educational resources through the Website.
 

3. Eligibility

The Services are available to individuals of all ages. However, individuals under the age of 18 must have the consent of a parent or legal guardian to use the Website and enroll in the Services. By using the Website, you represent and warrant that you meet the applicable eligibility requirements.
 

4. User Accounts and Registration

Certain features of the Website may require you to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
 

5. Fees and Payment

  1. Fees for the Services are published on the Website or available upon request from the Executive Director. All fees are payable to Tensai Ventures LLC through the Club’s approved payment channels.
  2. All fees must be paid in full before the commencement of the enrolled Program Cycle.
  3. Refund Policy. You may request a full refund within 48 hours of completing payment. After this period, no refunds will be issued for the current Program Cycle. Missed classes without 24 hours’ prior notice are counted as attended, and no make-up class or refund will be provided. Full refund terms are set forth in the Membership Agreement (PC-LEG-001).

6. Intellectual Property

  1. All content on the Website, including text, graphics, logos, images, audio, video, software, and other materials (collectively, “Content”), is the property of Tensai Ventures LLC or its licensors and is protected by applicable intellectual property laws.
  2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content on the Website without the prior written consent of Tensai Ventures LLC, except as follows: you may download or print one copy of a reasonable number of pages of the Website for your own personal, non-commercial use, provided you do not modify the Content and retain all copyright and other proprietary notices.
  3. All instructional materials, curricula, lesson plans, and training exercises provided during Club activities are the intellectual property of Tensai Ventures LLC. Recording, reproducing, or distributing these materials without authorization is strictly prohibited.
 

7. User Conduct

You agree not to use the Website or Services for any purpose that is unlawful or prohibited by these Terms. Specifically, you agree not to:
  1. Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website.
  2. Attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website.
  3. Use any robot, spider, scraper, or other automated means to access the Website for any purpose without our express written permission.
  4. Introduce any viruses, Trojan horses, worms, or other material that is malicious or technologically harmful.
  5. Post or transmit any content that is defamatory, obscene, abusive, threatening, or otherwise objectionable.
  6. Impersonate any person or entity or misrepresent your affiliation with any person or entity.

The Website may contain links to third-party websites or services, including but not limited to Chess.com, FIDE, and payment processing platforms. These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party websites is at your own risk and subject to the terms and conditions of those websites.
 

9. Disclaimer of Warranties

THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TENSAI VENTURES LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
PANIPAT CHESS DOES NOT GUARANTEE THAT ANY STUDENT WILL ACHIEVE A SPECIFIC CHESS RATING OR COMPETITIVE RESULT. THE RATING GOALS STATED IN OUR PROGRAM DESCRIPTIONS ARE ASPIRATIONAL TARGETS, AND INDIVIDUAL RESULTS DEPEND ON THE STUDENT’S EFFORT, APTITUDE, AND CONSISTENCY.
 

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TENSAI VENTURES LLC, ITS DIRECTORS, OFFICERS, MANAGERS, MEMBERS, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE WEBSITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Tensai Ventures LLC and its directors, officers, managers, members, agents, and employees from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Website or Services; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit or transmit through the Website.
 

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Website shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of such courts.
 

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Effective Date” at the top of this document and post the revised Terms on the Website. Your continued use of the Website or Services after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
 

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
 

15. Entire Agreement

These Terms, together with the Club Charter, Bylaws, Membership Agreement, Privacy Policy, and Code of Conduct, constitute the entire agreement between you and Tensai Ventures LLC with respect to the Website and Services.

Refund Policy

1. Introduction

At Sagar Bansal – Research, Education & Consulting (“we,” “us”, “our”), we aim to provide the highest level of service to our clients. However, we understand that there may be circumstances when you may want to cancel a service or request a refund. This policy outlines the conditions under which a service can be canceled or a refund can be made.

2. Cancellation

If you wish to cancel a service, please notify us immediately. We will try our best to accommodate your request, but please note that we cannot guarantee that we will be able to cancel services that have already begun or been completed.

3. Refunds

Refunds are only provided under the following circumstances:

If you have been charged incorrectly due to an error on our part, we will refund the full amount.
If you are not satisfied with our service, please notify us within 7 days after the service is provided. We will investigate the matter and if we determine that our service was not provided to a satisfactory level due to factors under our control, we may offer a partial or full refund.

Please note that refunds are not given by default in case of service cancellation. Each refund request is evaluated individually.

4. Refund Process

If your request for a refund is approved, the refund will be processed and a credit will be automatically applied to your original method of payment, within 14 days.

We reserve the right to update or change our Refund and Cancellation Policy at any time and you should check this Refund and Cancellation Policy periodically.

Welcome to Sagar Bansal – Research, Education & Consulting (“We”, “Us”, “Our”). You must agree to These Terms and Conditions to use our services. You agree to be bound by these Terms and Conditions by using or accessing our services.

2. Services

We provide Research, Education & Consulting services to help traders and investors reduce their risk and gain an edge. We reserve the right to change, suspend or discontinue any aspect of the services at any time, including availability of any feature or content without prior notice.

We also contribute to Academia by publishing research papers & reports in academic journals, presenting in international conferences and posting content on social media & charting platforms. These academic activities should not be confused with our professional activities regardless of whether a price is paid or not. 

The users must check the quotations for clarity as whether the service provided is in the capacity of an independent analyst or as an academic researcher where the nature of service becomes educational and not professional consultation.

3. Service Restrictions

We do not provide services to the citizens of countries where we do not have a license to offer such services. For a list of such countries, please contact compliance@cafest.bxgc.org.

4. User Obligations

As a user, you agree to use our services for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use of our services.
